MacQuarrie Stories
MACQUARIE, Peter
The only Macquarie (except the Governor and Lieutenant Hector Macquarie.) found in N.S.W. in 1821 is Peter Macquarie, who had four children baptized at St. Philip's between November 15th 1818 and January 16th 1825. This is the period during which the 48th Regiment was stationed here. In the regimental Muster records there is a Sergeant Peter McWharrie (also spelt Wharrie) who was one of 14 soldiers who transferred from the 48th Regiment to the 40th Regiment in 1824. (He had been serving in Van Diemen's Land). He returned to the depot in England in 1826.
Lachlan Macquarie spent most of his adult life involved in some form of military service. He joined the army in 1776 at the age of 15, and was serving in North America a year later. The whole character and fabric of his life was centered upon the pursuit of advancement through the military ranks. At the time of his retirement in 1822 he had reached the rank of Major General. All his training and expectations were conditioned by his understanding of the role of patronage in military promotion and the opportunities offered for financial initiative while performing the duties of a soldier of the Crown. In his journals there are frequent references to the military and naval ranks of numerous people with whom he had official dealings and personal contact;

Research Notes;
Just when we thought we had the naming pattern down pat and also looked for nicknames, I find that surnames may have changed, not just the spellings. An example given in the book “Discovering Your Scottish Ancestors”, by Linda Jonas & Paul Milner, 2002, they give the following;
“A family could have adopted the surname of the clan chief. The death record of a woman indicated that her maiden name was Agnes McLeod. The marriage record of her daughter gave the woman’s name as Ann McLeod. The woman’s own marriage record said her maiden name was Nancy MacCuaig. At first glance, this appears to be the wrong marriage record, but we had to investigate further. Could Nancy MacCuaig and Ann or Agnes McLeod have been the same person? We know that Ann, Agnes, and Nancy are all variations of the same given name. (I did not know that did you?) But what about MacCuaig and McLeod? We had to do some searching in original records and published books to resolve that one. In an index to cemetery inscriptions of the area where she lived, we found the notation “The MacCuaigs have changed their name to McLeod.”
We consulted a surname book and found no explanation, but in a book about clans we found that MacCuaig is a sept of McLeod. Therefore, the family had changed their surname to the clan name. Nancy MacCuaig and Agnes McLeod was indeed the same woman.”
Could this be a reason why we cannot connect some MQ’s back to Scotland? It is something to consider.

All clearances were not political: All of the highland clearance programs were not all political in nature. Those in the early 1800’s were economic based. The big landowners had to clear out the tenants in order to make room for sheep. A drive through the highlands today you will find more sheep then people.

especially constitute greeting: Whereas it is humbly meant and
shewn to me by my Lovite Ranald MacDonald of Ulva Esq'r
Heritable proprietor of the land and others aforementioned that by
Act of Sederunt of the Lords of Council and session of date the
fourteenth Decm'r Jan'y 8th fifty six anent removings it is inter alia
provided & declared that it shall be lawful for the Heritor or other
S_?? of the Lands in his option either to use the order presented
by the Act of parliament 1555 entitled Act Ament the warning
of tenants and thereupon pursue't removing and ejection or to bring
his action of removing against the tenant before the judge ordinary
and such action being called before the judge ordinary at least forty
days before the term of Whitsunday shall be held equal to a warn__??
in terms of the foresaid Act and the judge shall thereupon proceed
to determine in the removing in Terms of this Act of Sederunt in the
same manner as if a warning had been execute in terms of the foresaid
Act of Parliament. And albeit the complainer has oft and divers times
desired and required Duncan McInnis (McInnin??) Alexander Allan and
Hector MacQuaries pretended tenants and possessors of the lands of
Cove or of some part or portion thereof

and in Terms of the aforesaid Act of Sedurunt the said defenders aught and
should be decerned and ordained by Decree of Court to flit and remove
themselves and their foresaids forth and from their occupations and
possessions of the houses, grass and pasturage of the said lands and
pertinents thereof at the term of Whitsunday (Old Style) next to come
eighteen hundred and five years and from the arable grounds thereof, at the
separation of the ensuing crop from the ground in the said year and to desist
and cease therefrom and leave the same void and redd?? at and against the
said terms or at such other time or terms as may correspond with their
entry into possession to the effect the complainer or others in his name
may then enter thereto and set use and dispose thereof at pleasure conform
to the Laws and daily practice of Scotland used and observed in like cases
in all points.
HEREFORE IT IS MY WILL and I charge you strictly and command that ye
lawfully summon warn and charge the said defenders personally or at their
respective dwelling places to compeur? before me or my substitute in a
sherrif court to be holden within the ordinary court house at Tobermory
the (space left blank) day of March current in the hour of cause to answer
at the instance of the said pursuer in the matters libelled. That is to say
{or else} with ??? according to justice the which to do under the
subscription of the clerk of court at Tobermory the 6th day of March 1805 years.

INVERARAY JAIL;
Do we need more judges like these or did Scotland need more liberal judges?
John McQuarrie, age 22, single, born Kilmeny, Resident Islay sent to the Inveraray for Theft o f a Sheep carcass, trail date was 1 May 1867 he was tried by Sheriff Cleghorn and sentenced to 14 days imprisonment. He was admitted 17 Apr. 1867 released 15 May 1867 spent 28 days in the jail.
Kenneth McQuarrie age 13, single, born Ulva, resident Salen, Mull. Theft by housebreaking in the company of Alexander McPhail, stole 20 lb of sugar and a cheese. Tried 19 Feb. 1862 by Sheriff Graham, sentenced 20 days. Admitted 7 Feb. 1862, released 11 Mar. 1862 spent 32 days in Inveraray Jail.
If anyone has information on these two such as parents or birth dates please advise so I can get them listed in the database.
